Representation in the Vienna International Arbitral Center

In recent years, Austria has confidently entered the list of leading centers of international arbitration in Europe. One of the reasons for such a reputation is related to legal regulation, rooted in the Austrian Civil Procedure Code of the late XIX century. Most often, the VIAC arbitration clause can be found in foreign trade agreements.

The arbitration procedure is a dispute resolution method that, by agreement of the parties, cannot be resolved in a state court and therefore is submitted to an arbitration court. Unlike disputes resolved in state courts, the settlement of disputes in arbitration courts is usually faster and has a higher degree of confidentiality. In addition, the parties themselves make decisions related to the process (for example, the place of dispute resolution, the language of the proceedings, the applicable law and, above all, the appointment of arbitrators).

The Vienna International Arbitral Center (VIAC) was founded in 1975 as a division of the Austrian Federal Economic Chamber after Austria began to establish itself as a place of arbitration for trade disputes between East and West in the early 1970s. Currently, the 2013 VIAC Arbitration Rules (Vienna Rules) are in effect, as well as the mediation rules, which entered into force on January 1, 2016 and replaced the rules on reconciliation.

The two main activities of the VIAC are the arbitration method of dispute resolution and mediation. It is worth noting that the rules of mediation (or the Vienna Rules of Reconciliation) are not contained in an independent document, but are fixed as Annex 5 to the Vienna Rules. In the organizational structure of the VIAC, the Secretariat is led by the Secretary General, the Presidium and the International Council.
